Before you begin using JOBSFLARE.COM, you must read and agree to the Terms of Use (“Terms of Use”) and the following terms and conditions and policy, including future amendments (collectively, the “Agreement”). By accessing this Website, you agree to be bound by the Agreement. If you do not accept the Terms of Use and Privacy Policy of JOBSFLARE.COM, please do not use the Website.
The website, JOBSFLARE.COM is managed by iXpert Global Group Sdn Bhd (the “Company”) and any other website of the company accessed through this site (collectively, the “Website”), including but not limited to the information, text, images, links, sound graphics and video displayed here in (collectively, the “Materials”).

Description of service

JOBSFLARE.COM offers a job advertisement service, this service is used by an Employer to advertise a vacancy in their organization and used by Job Seeker as a source of job vacancy. At the moment the service offered at no charges for both parties (Job Seeker & Employer). From time to time, JOBSFLARE.COM may add additional services and may introduce premium advertisement service for Employer and premium service for Job Seeker. Premium service means paid service when used.

Proper Use

Job Seeker: You agree that you will only use the website for lawful purpose and for job seeking only. You may send your resume directly to employers and follow up your application status with them. Once you created your online resume, you agree that your resume is accessible by employer and the data accessed is at your own risk until you have deleted your resume from JOBFLARE.COM jobseeker personal area.

Once you created your online resume, you acknowledge and agree that your resume is accessible by Employers for the sole purpose of obtaining and assessing the suitability of your experience with the job offered by employer. The Company will not be responsible or held liable in any way if Employer breach the Terms of Use. You accept that your personal data given is at your own risk.

The Company reserves the rights to terminate you from using the service if found breaching the Terms of Use.

Employer: Employer will be able to post vacancy advertisement for free, unless they would like to use premium service that offered by the Company. Employers are entitled to access resume database, by that, Employers acknowledge and agrees that information of Job Seeker obtained is only for the sole purpose of obtaining and assessing the suitability of job seeker with the vacancy offered. Employer also acknowledges and agrees that it shall disregard any irrelevant resume during assessing jobseekers resume database, shall not use the job seeker data for other than obtaining the data for vacancy offered.

Employer shall responsible to the Material in its advertisement. The Company reserves the rights to edit advertisement content that found not meeting the purpose of its advertisement and appropriate to meet the purpose stated herein. The Company reserve the rights to terminate employer from using the advertisement service and remove any advertisement by Employer without any compensation or recourse to the Company in the event that the Employer breach any terms herein.

Job Seeker and Employer are required to follow the prohibited action while using the Website as stated herein:

Job seeker shall provide complete and accurate information of her resume based on her personal information, education level and experience.

Job seeker shall only respond to employment opportunity that related to the advertisement and Employer shall only reply to job seeker in connection to the position advertised. Any communication soliciting to other than job opportunity is prohibited.

Job Seekers are not encouraged to apply any job vacancy that needed them to pay for some deposit, placement fees or processing fees. Any Employer that advertised such job vacancy should state clearly what the purpose of payment is.

Employer shall provide and maintain accurate, complete and current data required to register with JOBSFLARE.COM.

Employer shall not disclose any confidential information obtained through the use of the advertisement service

Employer shall warrant that information obtained as a result of the use of the Service will not be used for solicitation to the job seeker for purchase of products / services, compilation of database information for any unauthorized use or sale, disclosure to any third party, contact with the user for any purpose other than potential employment, or any other purpose which is not consistent with JOBSFLARE.COM’s privacy policy and these terms of use.

Employer shall not use the advertisement Service to redirect user traffic and/or user resumes to the Employer's own website or any other third party website.

Any user, whether Job Seeker or Employer be solely responsible for maintaining the security of any user ID’s and / or passwords provided to them to access the Service provided by JOBSFLARE.COM.

Any user, Job Seekers or Employers are prohibited to use, edit or remove another Job Seeker or Employer account. 

Any user, whether Job Seeker or Employer are prohibited to download any other user identified information and use for any other reason other than for the job applied, as indicated in Clause 2 above.

Any user, whether job seeker or Employers are prohibited to edit or remove other user post.

All user are prohibited to violate or attempting to violate, interfere or hacking the Website system, security, server and accessing data which they are not authorized to access. Violations to the system, security, data or any related to the Website will results in criminal and/or civil liabilities to the doer.

All users are prohibited to store, transmitting or submitting material that violate any law /regulations or in any manner that may infringe the trademark, copyright, intellectual property rights or trade secrets of others.

All users are agree to defend, indemnify and hold harmless JOBSFLARE.COM from and against any claims, actions or demand, alleging or resulting from your use of the Service or your breach of the terms of use.

 

Exclusion of Liability

JOBSFLARE.COM offers an immediate advertisement, published by Employer for free advertisement and up to 48 working hours for featured advertisement including design (if any) and publishing. In any event, JOBSFLARE.COM shall not liable for any loss or damage incurred by Employer as a result of any failure or delay in publishing advertisement. For free advertisement, Employers are encouraged to check the content before publishing, as the content is not editable.

JOBSFLARE.COM offers a free job vacancy info service for Job Seeker and may offer premium service such as online resume service. Since the advertisement service are free, it is impossible that JOBSFLARE.COM to review all advertisements. Job Seekers are advised to be very careful in applying for any job vacancy advertised Job Seeker also should verify the job opportunity with accredited government body if you found some hidden charges apply by the Employer during the application or job process. JOBSFLARE.COM is not responsible or liable to any damages, loss or expense arising or in connection with any jobs advertisement in the Website.

JOBSFLARE.COM shall in no event be liable for any damages, loss or expense including without limitation, direct, special or consequential damage or economic loss arising from or in connection with:

Any access, use or the inability to access or use this website, or reliance on the materials and/or any information on the website.

Any system, server or connection failure, error, omission, interruption, delay in transmission, or computer virus.

Any use of or access to any other website linked to this website.

 

JOBSFLARE.COM, to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for particular purpose and non-infringement. Any hyperlinks to any other websites are provided as a convenience to you and not an endorsement or verification of such websites and such websites should be accessed at your own risk.

PAYMENT OF FEES

All amount owed by Employer to JOBSFLARE.COM must be paid within the specified payment terms. JOBSFLARE.COM may charge interest on any late payment. 

Prices or services may vary at any time without notice. Employers shall not be entitled for any rebate or discount on previously agreed contracts / sales orders as a result of changes to the pricing.

 

 

SUSPENSION OF EMPLOYER USAGE

Without prejudice to any other rights, JOBSFLARE.COM reserves the right to suspend access to any and all aspects of its advertisement Service in the event of non-payment of fees in full in compliance with the stipulated payment terms.

DISCLAIMER

JOBSFLARE.COM shall not be liable for any loss of information howsoever caused whether as a result of any interruption, suspension or termination of the Advertisement Service or for the contents, accuracy or quality of information available or transmitted through the Advertisement Service.

JOBSFLARE.COM shall not be liable for any loss or damages sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the Employer's or Job Seeker’s account and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed nor does it endorse any opinion expressed by any other User.

JOBSFLARE.COM does not warrant that its operation, process or any of its web sites will be free of any operational errors nor that it will be free of any computer virus, computer worm, Trojan horse or other harmful or malicious contents.

The Employer acknowledges that it is not JOBSFLARE.COM’s policy to exercise editorial control over and to edit or amend any data or contents of any emails or posting or any information that may be inserted or made available or transmitted to/from a third party in or through the Service.

 

 

USE OF DATA

 

The Employer hereby agrees and irrevocably authorizes JOBSFLARE.COM to:

use any data and information supplied by the Employer for JOBSFLARE.COM own internal and marketing purposes, to its supplying such data and information to any other associated companies or selected third parties to use for such purposes, and to its supplying such data and information to such third parties as may be necessary for the operation of JOBSFLARE.COM.

allow all data and information supplied by the Employer in using the advertisement Service to be retained at JOBSFLARE.COM for the use of JOBSFLARE.COM, notwithstanding the termination or suspension of the advertisement Service to the Employer herein.

 

INDEMNITY

 

All users, Job Seekers and Employers shall indemnify and hold JOBSFLARE.COM harmless at all times against all actions, proceedings, costs, claims, expenses, demands, liabilities, losses and damages whatsoever including without limitation for defamation, infringement of intellectual property rights, death, bodily injury, property damage or pecuniary losses howsoever arising which JOBSFLARE.COM may sustain, incur, suffer or pay arising out of or in connection with the use of the Service by you or your breach of the terms of this agreement.

TERMINATION

 

This Agreement and any other agreement of a similar nature may be terminated, at any time, by JOBSFLARE.COM by prior written notice to the users (Employer or Job Seeker) if it is found that the their uses of this service in any way or manner that may affect, limit or compromise the interest or business of JOBSFLARE.COM. No refund, compensation or consideration will be awarded to the Employer in the occurrence of such event.

ADVERTISEMENT POLICY

 

This policy is the best practice and procedure guidelines to ensure that Job Seekers are fully aware on all Material posted in the Website and enable Job Seeker to make an informed choice whether to apply the job vacancy or not:

No advertisement that discriminate against race, belief, age, gender or marital status.

JOBSFLARE.COM does not encourage advertisement with pay deposits, placement fees, processing fees or any other fees similar in nature, directly or indirectly, and/or require jobseekers to make purchases from the Employer. Any Employer who posts such job advertisement must indicate the deposits, fees or payment requirement clearly in the advertisement.

JOBSFLARE.COM does not accept job advertisements with dubious ethical credentials (e.g. social escorts, etc).

JOBSFLARE.COM does not accept job advertisements that are untrue or otherwise misleading (e.g. inappropriate use of job title, job descriptions or company description)

 

RIGHTS AND DESCRETION

JOBSFLARE.COM reserve the rights and discretion to remove any or all advertisement without any reason, any prior notice and with no refund.

JOBSFLARE.COM has the right to ensure that the job vacancies posted on the website are made in good faith and in compliance with the above policy, and deregister Advertisers who do not comply.

JOBSFLARE.COM has the sole right to determine whether the usage of the service offered are compliance to the Term of Use or not.

 

 

GOVERNING LAW

All users are responsible to ensure that they are complying with the country’s law, regulation and legislation on employment. This includes the responsibility to ensure that Job Seeker is of legal employment age in respective country to apply for a job.

This Agreement is governed by the laws of Malaysia and users hereby submit to the jurisdiction of the Malaysia court.
